ATM Holdings Inc. ("Guac," "we," "us," or "our") operates guacmexigrill.ca and the Guac Mexi Grill franchise system in Canada. This policy explains how we collect, use, disclose, and protect personal information, in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.

2. Scope

This policy applies to information collected through guacmexigrill.ca, our online contest platforms, our contact and franchise inquiry forms, and our email marketing program. It does not apply to information collected directly by individual franchise locations through in-store transactions, which are governed by that location's own practices and any point-of-sale provider's terms.

3. Information We Collect

We collect personal information you provide directly, including:

• Contact form submissions: name, email address, phone number, and message content.
• Franchise inquiries: name, contact information, business and financial background, and any documents you choose to submit.
• Newsletter sign-ups: name and email address.
• Contest entries: name, email address, and any information required by the official rules of the specific promotion, including our Gleam.io-hosted national contests and location-specific social media giveaways.
• Catering and event inquiries: name, contact information, and event details.

We also collect limited technical information automatically, including IP address, browser type, device information, and site usage data, through cookies and similar tools described in Section 8.

4. How We Use Your Information

• Respond to inquiries and requests.
• Administer contests and giveaways in accordance with each promotion's official rules.
• Send marketing communications where you've provided consent (Section 6).
• Evaluate franchise applications.
• Improve our website and marketing programs.

5. Who We Share It With

• Service providers who support our operations, including our website host and our contest and email marketing platforms.
• Franchise development advisors and legal counsel, for franchise inquiries only.
• The individual franchise location a submission relates to, such as a catering inquiry.
• Regulators or law enforcement, where required by law.

We do not sell personal information.

6. Marketing Consent

We send marketing emails only to individuals who have provided consent under Canada's Anti-Spam Legislation (CASL). You can withdraw consent at any time through the unsubscribe link in any email, or by contacting us using the details in Section 12.

7. Retention

We keep personal information only as long as necessary for the purposes in this policy, or as required by law. Contest entry data is retained for the period needed to administer the promotion and confirm winners, then securely deleted or anonymized.

8. Cookies and Analytics

Our website uses cookies and similar technologies to operate the site and understand how it's used. You can control cookies through your browser settings. Disabling cookies may affect site functionality.

9. Cross-Border Processing

Some of our service providers, including our website hosting and contest platform, may process personal information on servers located outside Canada. Where this happens, that information may be subject to the laws of the jurisdiction where it's processed.

10. Your Rights

You can request access to, or correction of, the personal information we hold about you. Contact our Privacy Officer using the details in Section 12. We'll respond within a reasonable time and in accordance with PIPEDA.

11. Children's Information

Our website and marketing programs aren't directed at children. We don't knowingly collect personal information from children online. Our School Lunch Program materials are directed at parents, guardians, and school administrators, not at children directly.
